Terms of Sale for Wild Call Coffee AS

Introduction

This purchase is governed by the terms of sale set out below for consumer purchases of goods over the Internet. Consumer purchases made online are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-Commerce Act, and these laws grant consumers rights that cannot be waived. The laws are available at www.lovdata.no.

The terms in this agreement should not be understood as limiting any statutory rights, but rather set out the main rights and obligations of the parties to the transaction.

1. The Agreement

The agreement consists of these terms of sale, information provided in the ordering solution, and any separately agreed terms. In the event of any conflict between the information provided, terms specifically agreed between the parties shall take precedence, provided this does not conflict with mandatory legislation.

The agreement will also be supplemented by relevant statutory provisions governing the purchase of goods between businesses and consumers.

2. The Parties

The buyer is the consumer placing the order.

3. Price

The stated price for the item is the total price the buyer must pay. This price includes all fees and additional costs (VAT). The buyer shall not bear any further costs that the seller has not informed the buyer of prior to purchase.

Shipping costs: Shipping costs are clearly displayed in the online store when ordering and are added to the product price. Free shipping may be offered on purchases above a certain amount. Current shipping costs and the threshold for free shipping are always shown in the shopping cart before the purchase is confirmed.

4. Conclusion of the Agreement

The agreement is binding on both parties once the buyer has submitted their order to the seller and received an order confirmation.

However, the agreement is not binding if there has been a writing or typing error in the seller's offer in the online store's ordering solution, or in the buyer's order, and the other party realized or should have realized that such an error existed.

5. Payment

The buyer pays at the time of ordering. We accept the following payment methods:

  • Payment card (Visa, Mastercard)
  • Vipps

The seller may reserve the purchase amount on the card at the time of ordering. The card will be charged when the item is shipped.

Buyers under the age of 18 may not shop in the online store without the consent of a parent or guardian.

6. Delivery

Delivery has taken place when the buyer, or their representative, has taken possession of the item.

If a delivery time is not specified in the ordering solution, the seller shall deliver the item to the buyer without undue delay and no later than 30 days after the customer's order. The item shall be delivered to the address provided by the buyer at the time of ordering.

The buyer will receive information about the expected delivery time in the order confirmation.

7. Risk of Loss

The risk for the item passes to the buyer once the buyer, or their representative, has received the item in accordance with Section 6.

9. Delay and Non-Delivery

If the seller does not deliver the item, or delivers it late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's part, the buyer may, depending on the circumstances and pursuant to the rules in Chapter 5 of the Consumer Purchases Act, withhold payment, demand performance, cancel the agreement, and/or claim damages from the seller.

For claims regarding breach of contract, notice should, for evidentiary purposes, be made in writing (email to hello@wildcall.coffee).

Performance

The buyer may uphold the purchase and demand performance from the seller. However, the buyer cannot demand performance if there is an obstacle the seller cannot overcome, or if performance would entail such a significant inconvenience or cost to the seller that it would be substantially disproportionate to the buyer's interest in the seller fulfilling the agreement.

Cancellation

If the seller does not deliver the item by the delivery date, the buyer shall request that the seller deliver within a reasonable additional period. If the seller does not deliver the item within this additional period, the buyer may cancel the purchase.

However, the buyer may cancel the purchase immediately if the seller refuses to deliver the item.

Damages

The buyer may claim compensation for loss suffered as a result of the delay. This does not apply, however, if the seller proves that the delay is due to an impediment beyond the seller's control that could not reasonably have been anticipated at the time of the agreement, avoided, or whose consequences could not reasonably have been overcome.

10. Defects in the Item — Complaints

If there is a defect in the item, the buyer must, within a reasonable time after discovering it or after it should have been discovered, notify the seller that they intend to invoke the defect. The buyer has always complained in time if this occurs within 2 months of the defect being discovered or of when it should have been discovered.

A complaint may be made no later than two years after the buyer took possession of the item. If the item, or parts of it, is intended to last significantly longer than two years, the complaint period is five years.

The Buyer's Rights in the Event of a Defect

If the item has a defect and this is not due to the buyer or circumstances on the buyer's part, the buyer may, depending on the circumstances and pursuant to the rules in Chapter 6 of the Consumer Purchases Act:

  • Withhold payment
  • Demand repair or replacement
  • Demand a price reduction
  • Demand that the agreement be cancelled
  • Claim damages

Repair or Replacement

The buyer may choose between demanding that the defect be repaired or that a replacement item be delivered. The seller may nevertheless refuse the buyer's claim if fulfilling it is impossible or would impose unreasonable costs on the seller.

Price Reduction

The buyer may demand a reasonable price reduction if the item is not repaired or replaced.

Cancellation

If the item is not repaired or replaced, the buyer may also cancel the purchase if the defect is not insignificant.

11. The Seller's Rights in the Event of Buyer Default

If the buyer fails to pay or fulfill their other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller's part, the seller may, depending on the circumstances and pursuant to the rules in Chapter 9 of the Consumer Purchases Act, withhold the item, demand fulfillment of the agreement, demand that the agreement be cancelled, and claim damages from the buyer.

Depending on the circumstances, the seller may also charge interest for late payment, collection fees, and a reasonable fee for uncollected items.

12. Personal Data

Wild Call Coffee AS is the data controller for the personal data collected.

In accordance with the General Data Protection Regulation (GDPR) and the Norwegian Personal Data Act, the seller may only collect and store the personal data necessary for the seller to fulfill its obligations under the agreement.

The buyer's personal data will only be disclosed to others if necessary for the seller to fulfill the agreement with the buyer (for example, to a shipping provider), or in cases required by law.

13. Dispute Resolution

Complaints should be directed to the seller within a reasonable time. The parties shall attempt to resolve any disputes amicably.

If this is not successful, the buyer may contact the Norwegian Consumer Council (Forbrukerrådet) for mediation. The Consumer Council can be reached by phone at 23 400 500 or at www.forbrukerradet.no.
